GENERAL TERMS OF USE OF THE FIAT MIO WEBSITE

a) Use Terms - Enforcement and Licensing

1) These terms of use (hereinafter referred to as “terms of use”) regulate the access and use of this website and any other website linked to it in any manner (all of which are hereinafter referred to as Fiat Mio Website, as well as any Fiat Mio project also designated as Fiat Mio Website, Fiat Mio Project, or Fiat Mio). These use terms establish the basic and necessary conditions for use of the Fiat Mio Website. Site use implies in immediate acceptance of these terms of use. These terms of use, in addition to setting the agreement terms of the relations between the parties, shall also be accepted as use license of the Fiat Mio Website. The Fiat Mio Website is regulated by copyright law. Use of the site in any form must precede acceptance of these terms of use. Acceptance or violation of the terms of use shall also classify as copyright violation of the Fiat Mio Website. In case you do not agree with any of the conditions and terms of use hereof, we advise you not to use this website as its use implies in automatic, irrevocable acceptance of its terms.

15) The user cannot practice any act that may be qualified as spam. In addition, no data present on the site can be used directly or indirectly for publicity, or any other commercial purposes without prior request and express consent.  User shall abstain from using any space granted by the Fiat Mio Website to post messages similar to spam, including posting of links and other information in spaces dedicated to comments and discussions, among others. User cannot collect any third party data through the site for commercial, publicity purposes and or others different from those of regular interaction and normal proposals by the Fiat Mio Website. (f) defend or promote illegal activity;
(g) personify or adulterate relationship with any entity or person, or in other manner manipulate headers or identifiers to mask content origin;
(h) announce any commercial enterprise (e.g. product and services) or engage in commercial activity (e.g. competitions or lotteries, sponsorship banners and or seeking goods or services), save when specifically authorized on this site;
(i) seek funds, announcers or sponsors;
(j) include program with virus, worms and or Trojans, or any code, file or computer program designed to interrupt, destroy or hinder any telecommunications software or hardware.
(k) interrupt normal dialogue flow, cause screen to scroll faster than other users can enter information, or seek to affect people's capacity to engage in activities on the site in real time;
(l) copy any other pages or images of this site, save with due authorization;
(m) include MP3 files;
(n) result in pyramid or similar scheme;
(o) result in data storage (i.e. uses any web space placed at disposal in the form of big files linked to other sites). You should supply a reasonable quantity of content to accompany these materials to enable part of the traffic to your site directly through us;
(p) disobey any policy or regulation established from time to time, on the use of this Site or any networks connected to this site; or
(q) contain links to other sites which in their turn contain the type of content that meets the descriptions established in items (a) to (p) above.

f) Contributions to the Fiat Mio Website

18) The Fiat Mio Website is a collaborative project and is built through contribution from website users who use it as a communications channel to post their works. 20) All brands, trade names, distinctive signs, patents, models and any other kinds of intellectual property belonging to Fiat and eventually used in the Fiat Mio Website, including its own brand and designation, belong to the respective owners. To use any of these brands, names and signs one must obtain previous and express consent of the owners.

i) Exclusion of Guarantees and Liability

21) For technical and operational reasons it is not possible to guarantee the availability and continuity of the Fiat Mio Website as well as prevent its fallibility.  All services offered through the Fiat Mio Website and by the Fiat Mio Website itself are provided in the condition they are in. The use of the Fiat Mio Website and its services shall be made at user own risk. The Fiat Mio Website is an open and collaborative site and its content is put together by a collective of users. The Fiat Mio Website does not inspect such content and cannot be held liable in any form thereof. Users are forthwith warned to proceed with diligence when using the Fiat Mio Website.

22) THE FIAT MIO WEBSITE THUS EXEMPTS AND REMOVES ITSELF, TO THE FULL EXTENT ALLOWED BY BRAZILIAN LAW AND ANY OTHER APPLICABLE, FROM ANY LIABILITY FOR DAMAGES OF ANY NATURE, LOSS OF PROFITS AND DAMAGES THAT MAY BE CAUSED OR ARISE FROM THE TERMINATION OR NON OPERATION OF THE FIAT MIO WEBSITE, AND ANY OTHER ARISING FROM OR CAUSED BY SERVICES OFFERED ON THE FIAT MIO WEBSITE, THE POSTING AND PROVISION OF CONTENT. THE FIAT MIO WEBSITE IS A MERE COMMUNICATIONS CHANNEL PROVIDED TO USERS AND DOES NOT INSPECT CONTENT. 25) The Fiat Mio Website does not guarantee the absence of prejudicial elements which may be present in content, including virus, that may damage information systems, or electronic documents and saved files.

26) The Fiat Mio Website does not guarantee legality, reliability and utility of content.

(D) QUALITY, LEGALITY, RELIABILITY AND UTILITY OF SERVICES, INFORMATION, DATA, FILES, PRODUCTS AND ANY TYPE OF MATERIAL EXISTING ON THE EXTERNAL PAGES.

THE FIAT MIO WEBSITE THUS EXEMPTS AND REMOVES ITSELF, TO THE FULL EXTENT ALLOWED BY BRAZILIAN LAW AND ANY OTHER APPLICABLE, FROM ANY LIABILITY FOR DAMAGES OF ANY NATURE, LOSS OF PROFITS AND DAMAGES THAT MAY BE CAUSED OR ARISE FROM THE USE OF SERVICES, CONTENT AND THE FIAT MIO WEBSITE ITSELF THAT MAY RESULT FROM PROBLEMS RELATED TO VERACITY, INTEGRITY AND AUTHENTICITY OF INFORMATION USERS PROVIDE ON THEMSELVES, AND SHALL NOT BE HELD LIABLE FOR ANY DAMAGES AND LOSSES OF ANY KIND THAT MAY ARISE FROM UNDUE USE OF THE PERSONALITY OF THIRD PARTIES MADE BY A USER IN ANY CLASS OR SITUATION WITHIN THE FIAT MIO WEBSITE.

j) Personal Data Protection

30) To access certain services and contents of the Fiat Mio Website it is necessary that the users previously provide some personal data. The Fiat Mio Website adopts security levels within the legal requirements for the protection of personal data. However, it is important that the user be informed of the nature and technical characteristics of the Internet, and that such protection is not infallible and is subject to violation by the most varied malicious practices.

l) Notice
31) All notices by user on the Fiat Mio Website shall be made solely and exclusively through alert to the site’s administration team, and notices sent by any other means (forums and posting on the site) shall be rejected.

The Fiat Mio Website consists in a free service which does not generate consumer relationship and is not regulated by the Consumer Protection Code. Any judicial action involving the Fiat Mio Website shall be mandatorily proposed in the jurisdiction of the city of Sao Paulo, State of Sao Paulo, waiving any other however privileged.
